On January 22, 2014, the Committee on Transport and Tourism of the European Parliament published a report on the proposal for a Regulation of the European Parliament and of the Council amending Regulation (EC) No 261/2004.
The report refers to an incomplete and inconsistent implementation of the existing Regulation by both the carriers and the national authorities causes confusion both for passengers and the industry as well as the fact that legal uncertainty has led to a series of European Court of Justice judgements, which have created extensive case law on the rights of passengers over the years.
While the report recognizes some elements of the Commission’s proposal as a step forward in the enforcement of air passenger rights, it suggests a number of amendments to the text proposed by the Commission, generally in favour of strengthening passenger rights.
The document also includes an opinion of the Committee on the Internal Market and Consumer Protection, suggesting additional amendments.
