AVIATION LAW NEWS: Dutch Aviation Company to relocate in Malta

Sunday, 13 May 2012 12:33

Aviation Cosmetics, a Dutch aviation company, which provides painting and furnishing aircraft, has opted to relocate its services to Malta's Aviation Park with an investment of twenty two million Euro which includes the construction of two hangers. The choice of Malta  is instigated by the fact that Malta enjoys attractive tax incentives for aviation companies or owners of an aircraft.

As from October 1st, 2010 Malta has introduced a new law on aircraft registration having acceded to the Cape Town Convention and the Aircraft Protocol following their adoption by the EU. The Aircraft Registration Act provides a comprehensive legal and fiscal framework for those owners and lessors who intend to register their commercial and private aircrafts, including a National Aircraft Register, allowing for certain initiatives like for example, the possibility to register an aircraft when still under construction. The new law caters for fractional ownership, aircraft leasing and aircraft finance with their respective legal complex considerations relative to mortgages and privileges.

In the aviation sector, Tanti-Dougall & Associates, Advocates can provide services in connection with aircraft registration, dry and/or wet lease agreements, aircraft financing and advice on tax applicability as well as on Health & Safety and aircraft security issues, including Airport Safety & Security and Airport Emergency Plan in line with the International Civil Aviation Orgnaisation (ICAO) and relative European regulations.
